We are pleased to announce that the Hon. John G. Koeltl of the U.S. District Court for the Southern District of New York has appointed Jason P. Sultzer of Sultzer & Lipari, PLLC to the Plaintiffs’ Executive Committee and, additionally, to serve as Liaison Counsel in In re Chobani Serving Size Litigation, Case No. 1:26-cv-05093-JGK.
The litigation alleges that Chobani, LLC misrepresented the protein content of its "20G Protein" yogurt sold in 32-ounce multiple-serving tubs. According to the complaint, Chobani inflated the declared serving size in violation of FDA regulations so it could claim 20 grams of protein per serving when the product actually provides only about 17.78 grams, causing consumers to pay a price premium for a claim the product does not meet.
Cases like this one matter because consumers rely on truthful labeling and lack any practical way to verify a manufacturer's per-serving claims at the point of sale. Holding manufacturers accountable helps ensure fair competition and that consumers receive what they pay for.
